TUESDAY,
MAY 17, 2011 – 7:00 PM
ZC Members: Edward Metzger, Chairman
Regan
Starkey, Vice Chairman
Larry
Marks, Secretary
Brent
Hunter, Member
Robert
Nelson, Alternate
Zoning Inspector: Dale Riggenbach
Trustee(s): Allen Gress, Vice President
Purpose: Discuss revisions to the
current
Zoning Resolution
WORK SESSION:
The work session was held at
the Nimishillen Township Hall located at 4422
The focus areas agreed to
are as follows:
1. Alternate
Energy Sources, i.e. Wind, Solar, Etc.:
The Zoning Commission will review Regional Planning Commission’s
recommendations and other area zoning requirements to find out what could be
added to our current Zoning Resolution.
2. Outdoor
Concerts:
Need definition and requirement list. Mr. Metzger proposed a ‘change of use permit’ to help control businesses (such
as bars) who have branched into other areas they were not originally set up to
do. He will bring an example to the next
work session.
2011, May 17 - Zoning Commission
Minutes (Cont.)
Zoning Inspector, Dale Riggenbach, will look into the
wording of other area Zoning Resolutions so the Board can incorporate it into
our ZR.
Mr. Starkey asked if anyone knew why some events in
the township required security while other events, such as concerts, have no
professional security. Mr. Riggenbach
will check with the Stark County Sheriff and the Beverage Distributors and find
out if they could help us define when this is required and if it can be applied
to all functions with a lot of attendees.
Mr. Nelson noted the Board could put defined sections
of the NEC (National Electric Code) into our Zoning Resolution. Problem was noted that if the county won’t
enforce the permit section they are charged with doing now, we stand little
chance of enforcing line and verse of the code itself. This needs more discussion.
3. Games of
Chance, 777’s, Computer Gambling:
Definitions will be drafted to be added to our Zoning
Resolution as well as reviewing the possibility of limiting this to the adult
entertainment areas.
4. Home
Business Guidelines:
Home Business Guidelines were once again
reviewed. There is much debate as to
what counts and what doesn’t count for a home based business. The Board noted they would address the other
issues (1, 2, 3 and 5) first and then attempt to come up with ‘interpretations’
for the Zoning Resolution.
5. Temporary
Signs:
The Board will review what constitutes a temporary
sign vs. what constitutes a permanent sign.
Equal enforcement of the rule was discussed.
NEXT WORK SESSION:
The next work session is
scheduled for May 31, 2011 at 7 PM at the Township Hall at 4422
2011, May 17 - Zoning Commission
Minutes (Cont.)
ADJOURNMENT:
The work session adjourned
at 8:10 PM.
