ZONING COMMISSION

REVISIONS TO ZONING RESOLUTION

                           TUESDAY, JUNE 28, 2011 – 7:00 PM

Purpose:                          Discuss revisions to the current NimishillenTownship

                                        Zoning Resolution

 

 

Chairman Metzger called the meeting to order at 6:55 PM.  Trustee Gress passed out drafts of policies he had been working on and Dale passed out copies of information he got from Canton Township Zoning Inspector.

 

APPROVE MINUTES:

 

STARKEY MOTIONED TO APPROVE THE MAY 31, 2011 MINUTES SECONDED BY NELSON.  MOTION CARRIED.

 

Discussions were held on the following:

 

*     Changes to Draft II – Policy for outdoor festivals, carnivals, concerts and similar amusement establishments and other public assemblies of a temporary nature prepared by Trustee Gress.  Change H on page 2 and other minor wording.

 

          STARKEY MOTIONED TO APPROVE DRAFT II ‘POLICY FOR

          OUTDOOR FESTIVALS WITH CHANGES NOTED SECONDED BY

          METZGER.  MOTION CARRIED.

 

 

 

2011, June 28 - Zoning Commission Minutes (Cont.)

 

*     Discussion - Application for a certificate for permission to host an outdoor festival, carnival, concerts and drama productions, and similar amusement and other public assemblies of a temporary nature for commercial projects (churches exempt) prepared by Trustee Gress. 

 

          STARKEY MOTIONED TO APPROVE THE APPLICATION FOR A

          CERTIFICATE FOR PERMISSION TO HOST AN OUTDOOR

          FESTIVAL SECONDED BY METZGER.  MOTION CARRIED.

 

*     Discussion - Policy for Certificate of Change of Use/Occupancy prepared by Trustee Gress.  After suggested changes, Gress said he would re-write the policy and have it ready for the next meeting to pass by resolution.

 

*     Discussion – Application for a certificate of change of use/occupancy for commercial property prepared by Trustee Gress.  After discussion, it was decided to use Lake Township’s application. Gress will re-write the Application and have it ready for the next meeting to pass by resolution.

 

*     Requesting boundary surveys for site plans – Metzger didn’t have time to check into this but will have something for the next meeting.  Much discussion was held on this topic.

 

*     777’s – Riggenbach went to Canton Township and talked to the zoning inspector.  He said there’s a state law coming out in about a year and the state will regulate businesses where 777’s are permitted.  Because it’s a ‘gambling’ activity, they give something in lieu of cash, i.e. gift certificates, to get around operating 777’s. You have to be a paid member.

 

          To bring revenue into the township, even though RPC denied their

          request, Riggenbach said Canton Township prepared a ‘temporary’

          Conditional Zoning Certificate charging businesses $100 / machine and

          $500 / Conditional Zoning Certificate.

 

          Metzger said he thinks it would be okay if we wait it out and let the state

          do their regulations.  If it’s not in our Zoning Resolution, we can’t permit it.

 

          NOTE:  Per Cliff Meidlein at RPC, if something is NOT written in our

                       Zoning Resolution, it is not permitted.

 

*     Small Wind Energy Systems – It was agreed to leave as is for free standing and put something in for structure mount.  Gress will prepare a draft for structure mounting and solar panels and present it at the next meeting.  Metzger will check what Jackson Township has for solar panels.  Riggenbach said he would get information on solar panels from Richfield.

NEXT MEETING: The next meeting is scheduled for Tuesday, July 12, 2011 at 7 PM at the Township Hall at 4422 Maplegrove NE (Fire Station No. 2).
