Purpose:      Motion to initiate the proposed text amendment to delete strip

mining in R-R Rural Residential Districts and in R-1 Single

Family Residential Districts from the current Nimishillen

Township Zoning Resolution.

 

PROPOSED TEXT AMENDMENT

 

NIMISHILLEN TOWNSHIP ZONING RESOLUTION

 

R-R  RURAL RESIDENTIAL DISTRICT

 

SECTION  701.2.B.   Conditionally Permitted Uses

 

Delete:  “1.  Surface mining or strip mining, subject to Subsections 105, 110, 111, 112,                           113, 114, 125.”

 

Renumber all remaining conditionally permitted uses in this section

 

 

R-1  SINGLE FAMILY RESIDENTIAL DISTRICT

 

SECTION  702.2.B.   Conditionally Permitted Uses

 

Delete:  “1.  Surface mining or strip mining, subject to Subsections 105, 110, 111, 112,                           113, 114, 125.”

 

Renumber all remaining conditionally permitted uses in this section

Mr. Metzger brought the meeting to order at 7:00 PM and asked for a motion to approve the minutes from July 15, 2008.

 

With everyone having read the minutes and with no further discussion, REGAN STARKEY MOTIONED TO APPROVE THE JULY 15, 2008 ZONING COMMISSION MINUTES AS WRITTEN SECONDED BY LARRY MARKS.  ALL WERE IN FAVOR.  MOTION CARRIED.

 

The next item for discussion was the proposed text amendment presented by Zoning Inspector Keith Lasure.  Mr. Metzger asked the Board if they had any questions for Mr. Lasure.  Trustee Gress explained why it would be good to delete strip mining from both R-R & R-1 Districts.  Discussion followed on pros and cons of deleting strip mining from both R-R and R-1 vs. deleting strip mining only from R-1.  Discussion followed.

 

REGAN STARKEY MOTIONED TO INITIATE AND MOVE FORWARD WITH THE PROPOSED TEXT AMENDMENT TO DELETE STRIP MINING FROM R-R AND R-1 DISTRICTS SECONDED BY DALE RIGGENBACH. 

 

Roll call voting went as follows:

 

                    Dale Riggenbach    -         In Favor

                    Ed Metzger             -         Not in Favor (Too restrictive – need

to allow businesses in the township)

                    Regan Starkey        -         In Favor

                    Jeff Zucal               -         Not in Favor (Would like to see

 revenue – not opposed to deleting in

R-1 stating there would be fewer

neighbors in R-R districts)

                    Larry Marks           -         Not in Favor (Would like to see it

split and only delete in R-1 and would

like to know the revenue)

                    Bill Ehlers              -         No in Favor (Feels ZR should have

controls in place regarding land use

and should be used for the greatest

potential use)

 

MOTION WAS DENIED.

It was brought to the table for discussion to only delete strip mining in R-1 Single Family Residential Districts.  Discussion followed.

 

After discussion and with no further questions, ED METZGER MOTIONED TO DELETE THE PROPOSED TEXT AMENDMENT FROM R-1 SINGLE FAMILY RESIDENTIAL DISTRICTS ONLY AND TO LEAVE IT AS CURRENTLY WRITTEN IN R-R RURUAL RESIDENTIAL DISTRICTS IN THE NIMISHILLEN TOWNSHIP ZONING RESOLUTION.

R-1 SINGLE FAMILY RESIDENTIAL DISTRICT

The rest of the meeting was spent on possible revisions to the Nimishillen Township Zoning Resolution regarding home occupations.
