On Thursday, April 28, 2011, the Board of Trustees of Nimishillen Township met in regular session at 7:00 PM at the Nimishillen Township Hall located at 4422 Maplegrove NE with the following members present: Trustee President Michael L. Lynch, Trustee Vice President Allen E. Gress, Trustee Lisa R. Shafer and Fiscal Officer Barry L. Evans.

 

Trustee Lynch called the meeting to order at 7:00 PM and led the staff and audience in the Pledge of Allegiance.

 

NOTE:  All reports are available at the township office located at 4915 N. Nickelplate.  Copies are 10¢ per page.

 

INVOCATION:  Trustee Lynch gave the invocation.

 

FIRE DEPARTMENT: (Chief Richard Peterson)

 

Resolution – Approve dispatching contract: TRUSTEE SHAFER MOTIONED TO RENEW CANAL FULTON FIRE DEPARTMENT DISPATCHING AGREEMENT AT $1,887.00/MO. SECONDED BY TRUSTEE GRESS.  MOTION CARRIED.  RES#11-101

          Roll call voting:  Mrs. Shafer – YES, Mr. Gress – YES, Mr. Lynch - YES

 

Resolution – Lawn care quotes for fire stations: The following quotes were received:

 

v    Mahon Lawn & Landscaping of Louisville, OH - $105.00

v    T-Mack Lawn Care of Louisville, OH - $125.00

v    Turf Tenders of Canton, OH - $135.00

v    Enviroscapes of Louisville, OH - $175.00

 

Chief Peterson recommended Mahon Lawn Care since they had the lowest quote.  TRUSTEE GRESS MOTIONED TO APPROVE MAHON LAWN CARE TO MOW ALL FIRE STATIONS AT $105.00 PER MOWING SECONDED BY TRUSTEE SHAFER.  MOTION CARRIED.  RES#11-102

Hire part-time civilian dispatcher: TRUSTEE SHAFER MOTIONED TO HIRE TAMMY ROSS AS A PART-TIME CIVILIAN DISPATCHER EFFECTIVE MAY 1, 2011 AT $11.54 / HR. SECONDED BY TRUSTEE GRESS.  MOTION CARRIED.  RES#11-103

Specifications for renovations at all three (3) fire stations:  The Board approved Chief Peterson to develop bid specs for minor renovations/repairs for all three fire stations.  The bids will be for either a package deal or for individual repairs at the different stations.

Board approval to meet with Hammontree:  The Board gave approval to Chief Peterson to meet with Hammontree & Associates to get a final septic system plan for Station 2.  Chief Peterson said he would get three different proposals and the Board could then make a decision on which one to go with.

 

ROAD DEPARTMENT: (Jack Magee, Superintendent)

 

Excuse Highway Superintendent:  Trustee Lynch excused Jack from tonight’s meeting.

 

Resolution - Street sweeping quotes: The Township received three (3) quotes for street sweeping:

 

v    Riley Sweeping, Walton Hills, OH  - $4,998.00

v    Buckeye Sweeping, Akron, OH  - $5,140.00

v    Alpha &  Omega Power Sweeping, Canton, OH - $3,000.00

 

TRUSTEE GRESS MOTIONED TO AWARD THE STREET SWEEPING CONTRACT TO ALPHA OMEGA FOR A TOTAL COST OF $3,000 SECONDED BY TRUSTEE SHAFER.  MOTION CARRIED.  RES#11-104

ODOT Plan for SR62: Trustee Gress reported on the ODOT plan for the SR 62 Corridor, which will partly affect Nimishillen Township changing the TV station entrance from California to Reno and some changes at the St. Thomas Aquinas area.

ZONING DEPARTMENT: (Dale Riggenbach, Inspector)

 

Updates on the following three properties:

 

v   6311 Louisville Street - vacant property: 

1)    Received 3 quotes - spoke to Rick Crawford – said he’s okay with his $500 quote, which was the lowest of the three

2)    Talked to Mike Bickis re: demo of garage – make sure no liens – checked with Auditor and there are no liens on the property at this time

3)    Called Safeguard. Spoke to my contact, Mike, who issued a vacancy inspection on 4/22. Advised Mike property needs to be secured.

4)    Called Christian at Safeguard for timeline as to when tasks would be done – explained to him this property needs to be addressed ASAP

 

 

2011, April 28 Trustees Minutes (Cont.)

 

v   6271 Apple Street – Gary Reed:

1)    Equipment has not yet been removed

2)    On 4/21, Gary assured me the jeep would be gone along with the cab but didn’t have a solid date

3)    Called Mike Bickis.  He spoke to Gary Reed.  Gary explained situation to Mike B.

4)    Mike Bickis will file a lawsuit in regards to this matter per conversation with him on 4/27/11.

 

v   4900 Eshelman – Fimple/Duplain case:

1)    Talked to Mike Bickis and Atty. Savage who is representing Sean Fimple.  Atty. Savage is to consult with his client.  Bickis said they can still go before the BZA and ask for a variance regarding the 2’ setback. Dale said he’d check with Atty. Bickis for an update regarding the timeline of this case.

 

Road closings: Maplegrove and Eshelman will both be closed at the RR crossings from May 9th to approximately May 16th to upgrade the crossings.

 

Township Zoning Commission work session:  Nim. Twp. Zoning Commission and at least one trustee will meet at 7 PM on Tuesday, May 17th to discuss possible revisions to the current Nimishillen Township Zoning Resolution.

2011, April 28 Trustees Minutes (Cont.)

 

CITIZEN’S CONCERNS:

 

Ryan Dean, 5280 Forest Lake Drive, Uniontown with CHESEPEAKE ENERGY stepped to the podium and spoke about the following on ‘fracking’ and drilling:

 

v    Originally from Oklahoma

v    Seeking leases in Stark County for horizontal drilling and hydraulic fracking

v    Said not actively seeking permits at this time in the township

v    Said they’d be responsible for any road damages from their heavy equipment

 

Trustee Shafer said she would love to ban this in the township but the trustees have no authority to do so.  She also spoke about residents’ concerns and reported 32 new agreements were written in the township in addition to nine (9) new agreements in the City of Louisville.  Mrs. Shafer feels there needs to be a community meeting with Mr. Dean present to inform the residents of what’s really going on.  Mrs. Shafer asked Sharon to draft a letter to State Representative Christina Hagan and ask her if she would review drilling regulations.  The Board agreed.  Trustee Lynch said he would call Ms. Hagan and invite her to come to a meeting to speak on this subject.

 

TRUSTEES:

 

Update - Employee Handbook:  Trustee Gress said the updates on the handbook are moving along.  A work session was set for Thursday, May 12th at 6 PM to go over the changes and then send on to the prosecutor for review.

 

Grant writer interviews: Two applications were received for the position of grant writer.  Interviews will be held starting at 6:30 PM on Thursday, May 26th.  The regular Trustees’ meeting will follow at 7.

 

Trustee Lynch reported he heard about a county pool of available grant writers that would be made available to us but said he didn’t know what the cost would be.
