Nimishillen Township Board of Trustees

Regular Meeting

April 23, 2009

 

On Thursday, April 23, 2009, the Board of Trustees of Nimishillen Township met in regular session at 7:00 PM at the Nimishillen Township Hall located at 4422 Maplegrove NE with the following members present:  Trustee President Lisa R. Shafer, Trustee Allen E. Gress and Fiscal Officer Barry L. Evans. Trustee Vice President Michael L. Lynch was absent.

 

Trustee Shafer called the meeting to order at 7:00 PM and led the staff and audience in the Pledge of Allegiance.

 

MOMENT OF SILENCE:

 

Trustee Shafer asked for a moment of silence.

 

Trustee Shafer excused Trustee Lynch, Zoning Inspector Keith Lasure and Fire Chief Rich Peterson from tonight’s meeting.

 

GUEST SPEAKER:

 

Laura Fauss, RS, Public Health Sanitarian with the Stark County Health Department, spoke on the following:

 

 

Trustee Shafer gave an update on the mosquito-spraying program. (letter attached)

 

ROAD DEPARTMENT: (Jack Magee, Highway Superintendent)

 

Driveway culvert policy: Jack Magee quoted the O.R.C. 5543.16, which provides that in the ordinary case it is the responsibility of a landowner to ‘construct and keep in repair all approaches or driveways from the public roads…’ This includes driveway culverts, including those located in the road right of way.  O.A.G. 82-025.  The board agreed that the township would abide by the Revised Code.

 

Resolution for ‘Engine Brake Sign’:  After discussion, TRUSTEE GRESS MOTIONED TO PLACE AN ‘ENGINE BRAKE SIGN’ ON THE EAST SIDE OF SR44 800’ NORTH OF BELLHURST AS OUTLINED IN THE O.R.C. SECTIONS 4513.221 (E)(4) AND 505.17 (A) REGARDING ENGINE NOISE SECONDED BY TRUSTEE SHAFER.  MOTION CARRIED.  RES#09-077

Speed bumps / ‘Children at Play’ signs: Speed Bumps: Jack explained speed bumps make it difficult for snowplows on blacktop roads.  ‘Children at Play’ signs: There’s already a resolution on the books (Res#05-052), which states all ‘Children at Play’ signs would be removed because ODOT does not approve ‘Children at Play’ or similar signs and this type of signage is not recommended for use on any roadway at any time and the road crew was instructed to take down all ‘Children at Play’ signs in the township.

 

Award bids for road materials: Trustee Gress reminded everyone the road material bids deadline is May 13th at 2 PM and bids will be opened at 7:30 PM at the regularly scheduled trustees’ meeting on May 14th.

 

Road levy information: After discussion, the board agreed an article should be put in the paper promoting the road levy.  Joanne Moody will handle.

 

Road Report for April 23, 2009:  TRUSTEE GRESS MOTIONED TO APPROVE THE WRITTEN ROAD REPORT FOR 4/23/09 SECONDED BY TRUSTEE SHAFER.  MOTION CARRIED.   RES#09-078

Paving / roadway improvement project: Jack reported the deadline for the asphalt paving bids (does not include chip & seal) is May 27th at 2 PM.  Sealed bids will be opened and read at 7:30 PM at the regularly scheduled trustees’ meeting on May 28th.

 

Eastview project: Discussion was held on the off-road drainage problem on Eastview.  Mrs. Shafer explained we are waiting for an opinion from the Stark County Prosecutor.  A letter will be sent to the County Commissioners and Engineers.

 

St. Joe’s project: Discussion was held on the St. Joe’s project regarding sending a letter to the commissioners jointly with the City of Louisville.  Township secretary, Sharon Shaub, will contact the City regarding the letter.

 

FISCAL OFFICER: (Barry L. Evans)

 

Records retention: Barry reported each department should go through their files to determine what records they want destroyed.  He and Mrs. Shafer will then get together to determine which records should be destroyed.

Trustee Gress said it’s taken Metzger Park 25 years to get where it is today.  Molly Stark Park will move forward in three ‘steps’:

SCTA dinner: Louisville Baptist Temple located at the corner of California & Columbus has committed to hold the SCTA dinner on June 18th.  A sponsor is still needed but all is moving forward.

APPROVE ALL PURCHASE ORDERS, FINANCIAL REPORT AND PAY BILLS:

 

TRUSTEE GRESS MOTIONED TO APPROVE ALL PURCHASE ORDERS, FINANCIAL REPORT AND PAY BILLS IN THE AMOUNT OF $58,868.78 SECONDED BY TRUSTEE SHAFER.  MOTION CARRIED.  RES#09-080
