Appeal #571 –
Emmanuel Bible Church, 5370 N. Nickelplate NE - Variance request for 50 parking spaces rather than
the minimum 78 spaces required as permitted and regulated in Article IX, Sec.
901.1, Paragraph C, in the Nimishillen Township Zoning Resolution.
Chairman
Brahler opened the hearing at 7:00 P.M. and introduced the Board of Zoning
Appeals, Zoning Inspector Dale Riggenbach, Township Trustee Allen E. Gress and
Township Secretary Sharon Shaub. Brahler
did a mass swearing in by asking everyone in attendance to swear that the
information they were about to present, either in oral or written form, is true
and accurate to the best of their knowledge.
The people responded by stating, “I do”.
TONIGHT’S CASE - APPEAL #571:
Bill
Exposito, 3088 Trussel Drive, Canton, Ohio stepped to the podium and said it took two (2)
months for the Fire and State Inspectors to try to determine how the fire
started. It was thought it started in
the furnace area but they could not come to a conclusion as to how it
started. In mid May of 2010, they gave
the go ahead to work with the insurance company and move forward.
In October or November 2010, they started the
destruction of the church and recently hired Miller Construction Co. to
re-build it. This is when parking came
into question. Mr. Exposito said
attendance averages around forty (40) per week.
They have a total of about fifty (50) members.

Mr. Exposito said according to the requirements, they
need approximately 80 parking spaces, which are determined by building
size. When it’s all said and done, there
will be approximately fifty (50) parking spaces which is why they had to go for
a variance.
When asked if members of the congregation ever parked
on the street before, Mr. Exposito said no.
He also explained that because of parking spaces and handicapped spots,
the church will not be exactly in the same place as it was.

FAVOR OF OR OPPOSED TO THE VARIANCE REQUEST:

Most of the congregation of the church was in
attendance, and they were all in favor of the variance request.
Mr. Exposito said he talked to all of the neighbors
by the church, and they were all in favor of putting up a new building.
Zoning Inspector, Dale Riggenbach, said there were
not any calls or letters received at the office either for or against this
variance.
OPPOSED:
There was no one present to speak against the variance.
With no further questions and/or discussion, Brahler
asked for a motion for a ballot vote.
PAN ASLANIDES MOTIONED FOR A BALLOT VOTE SECONDED BY
GARY BRAHLER. ALL VOTED YES – MOTION CARRIED
GARY BRAHLER MOTIONED TO APPROVE THE VARIANCE REQUEST
FOR 50 PARKING SPACES RATHER THAN THE MINIMUM 78 PARKING SPACES REQUIRED AS
PERMITTED AND REGULATED IN ARTICLE XI, SEC. 901.1, PARAGRAPH C, IN THE NIMISHILLEN TOWNSHIP ZONING RESOLUTION
SECONDED BY PAN ASLANIDES. MOTION CARRIED

Brahler stated the request for the variance was APPROVED and instructed Mr. Exposito to
contact the zoning inspector to get the proper permits.
