BOARD OF ZONING APPEALS

TUESDAY, December 7, 2010 – 7:00 PM

Purpose:

 

·        Appeal #557 – Sam Noturno of 2508 Demington, Canton, OH 44708 is requesting a variance to continue the nonconforming use of 7921 Georgetown St., Louisville, OH 44641, (Parcel No. 33-00028) as a social club and restaurant under a new owner and name, formerly known as The German American Club, pursuant to Article X, Nonconforming Uses, Section 1001.1, Paragraph B, of the Nimishillen Township Zoning Resolution.

 

Chairman Riggenbach opened the meeting at 7:00 P.M. and introduced the Board of Zoning Appeals, Trustee Gress, Zoning Inspector Keith Lasure and Township Secretary Sharon Shaub.  Mr. Riggenbach swore in everyone in attendance by asking them to swear that the information they were about to present, either in oral or written form, is true and accurate to the best of their knowledge.  The people responded by stating, “I do”.

 

Case:  Appeal #557:

 

Sam Noturno, 2508 Demington, Canton stepped to the podium and said he’s asking for continued use of 7921 Georgetown as a restaurant and bar.  It will be similar to what’s there now but he will be making some updates.  He said Sam Ferruccio is helping him get his D5 and D6 Liquor License – said he should have no problem because he’s never had any arrests or felonies.

 

Mr. Noturno said the club was in serious disrepair.  It needs new heating and the kitchen needs to be updated among various other repairs, which he either has done or is in the process of doing.  The pavilion needs to be repaired or maybe even replaced.  Other extreme remodeling is needed such as the ceilings and plumbing.  He has also cleaned out the creek and cleaned up the property and wants to reclaim what was there. The lot will be paved.  People will be able to fish.  No membership is needed.  He plans to open in mid June 2011 and will have twenty-one (21) employees. 

 

When asked by a Board member if he’s ever run a restaurant before, he said no but his fiancé is manager at the Outback and he thinks the two of them will be able to make it a success.  He said he’s been going there ever since he was a kid and has always loved it there.

When asked by a Board member if he planned to have bands outside in the summer, he said no.  When asked by a resident in the audience if it was going to be a rap music club, Mr. Noturno said no.  He explained he wants to hold weddings and receptions.  It will be a very family oriented establishment reasonably priced.  He will have some German foods and wine.  The downstairs will be informal and the upstairs will be more formal with a bar.  When asked if breakfast would be served, Mr. Noturno said not at this time but maybe later on.  Lunch and dinner will be served.  They will be closed Mondays and Tuesdays.

 

With no one in attendance to speak either for or against the variance request and no further questions from the Board, Chairman Riggenbach asked for a motion for a ballot vote.

 

FLOYD FERNANDEZ MOTIONED FOR A BALLOT VOTE SECONDED BY GARY BRAHLER.  MOTION CARRIED.

Chairman Riggenbach stated the request for the variance was APPROVED and instructed Mr. Noturno to contact Mr. Lasure during office hours so Mr. Lasure can issue him the proper permits.

 

Old Business

 

Discussion was held regarding the 4900 Eshelman case.  Mr. Lasure gave the Board an update.  Said it’s going to Court.

 

New Business

 

Gary Brahler asked if the meetings could be changed from Tuesdays to Wednesdays.  No one could agree on a ‘day’.  This will be discussed and decided at the next meeting during the organizational meeting.

 

Approval of Minutes

 

BILL EHLERS MOTIONED TO APPROVE THE MINUTES FOR NOVEMBER 2, 2010 AS WRITTEN SECONDED BY PAN ASLANIDES.  ALL VOTED YES.  MOTION CARRIED.
