BOARD OF ZONING APPEALS

Purpose:

·        Organizational meeting, and;

·        Appeal #559 – Brenda Bauer of 7326 Hahn Street NE, Louisville, OH is requesting a Conditional Zoning Certificate for a home business to do billing and other necessary paperwork out of her home for a roofing business subject to Article XI Subsection 115 Paragraph F of the Nimishillen Township Zoning Resolution.

 

Chairman Dale Riggenbach opened the meeting at 7:00 P.M. and introduced the Board of Zoning Appeals,  Zoning Inspector Keith Lasure, Township Secretary Sharon Shaub, and Trustees Lisa Shafer and Allen Gress.  Mr. Riggenbach swore in everyone in attendance by asking them to swear that the information they were about to present, either in oral or written form, was true and accurate to the best of their knowledge.  The people responded by stating, “I do”.

 

Organizational Meeting:

 

Chairman: Gary Brahler motioned to re-appoint Dale Riggenbach as Chairman seconded by Floyd Fernandez.  All voted yes.  Motion carried

 

Vice-Chairman: Dale Riggenbach motioned to appoint Gary Brahler as Vice Chairman seconded by Pan Aslanides.  All voted Yes.  Motion carried

 

Secretary: Gary Brahler motioned to re-appoint Pan Aslanides as Secretary seconded by Ed Metzger.  All voted yes.  Motion carried

 

Day / Time of meetings: Floyd Fernandez motioned keeping the meetings the first Tuesday of each month at 7:00 p.m. at the township hall with adjustments made as necessary for holidays or any other special arrangements seconded by Gary Brahler.  All voted yes.  Motion carried

Case:  Appeal #559:

 

Brenda Bauer of 7326 Hahn NE, stepped to the podium and stated she wants to start a roofing business and do billing and other necessary paperwork out of her home. She said there would be no equipment stored at her residence – nothing would be sitting outside.  Ms. Bauer said she’s considering purchasing a warehouse in Alliance to store equipment or possibly build a building on her property in the future to store trucks.  Discussion was held as to whether or not Ms. Bauer would have to do a zone change to build a building on her property.  It was noted that Keith explained the rules of parked vehicles at a residence, and Ms. Bauer also said clients would not be coming/going to her residence.

 

 

Keith Lasure said he did not receive any calls or complaints regarding the request for this variance.

 

With no correspondence received at the township office and no one else to speak either for or against the request for a variance for a home occupation, Mr. Riggenbach asked for a ballot vote.

 

Floyd Fernandez motioned for a ballot vote seconded by Pan Aslanides.  All voted yes.  Motion carried

Chairman Riggenbach stated the request for a Conditional Zoning Certificate for a home business was APPROVED and instructed Ms. Bauer to make arrangements with Mr. Lasure to pick up her permit.

 

Old Business:

 

There was no old business to discuss.

 

 

New Business:

 

Keith reported there’s a Government Law Seminar on Saturday, February 20th at the Holiday Inn – Belden Village – from 9 AM to 2 PM.  The township board of trustees approved the chairpersons from each zoning board and the township zoning inspector to attend.

Approval of Minutes:

 

Gary Brahler motioned to approve the written minutes for December 1, 2009 as written seconded by Floyd Fernandez.  All voted yes.  Motion carried

 

Adjournment:

 

Pan Aslanides motioned to adjourn at 7:10 PM seconded by Ed Metzger.  All voted yes.  Motion carried
