Appeal #561 – Cynthia M. Long of 9327
Georgetown St. NE, Louisville, OH, zoned R-1 Single Family Residential, is
requesting that her current Conditional Zoning Certificate #714 for a home
occupation include a Type ‘A’ Day Care Center subject to Sections 702.2(B)(14)
Article XI Conditional Zoning Certificates, Section 1102 Subsections 102, 103,
104, 109, 114, 122, 125, 126, 133 and 134 of the Nimishillen Township Zoning
Resolution.
Due
to Chairman Dale Riggenbach’s absence, Vice Chairman Gary Brahler opened the
meeting at 7:00 P.M. and introduced the Board of Zoning Appeals, Township
Secretary Sharon Shaub and Trustee Allen Gress.
Mr. Brahler swore in everyone in attendance by asking them to swear that
the information they were about to present, either in oral or written form, was
true and accurate to the best of their knowledge. The people responded by stating, “I do”.
Case: Appeal #561:
Cynthia M. Long of 9327 Georgetown stepped to the podium and explained she wants to start a Type ‘A’ Day Care Center in her home and include it on her current Conditional Zoning Certificate #714 for a home occupation which permits her to give piano lessons and teach early childhood music.
Mrs. Long stated she applied to the Ohio Department of Job & Family Services and had her background check and other necessary testing for a Type ‘A’ Child Care Center. All has been approved by the State. She said she will never have more than 12 children in her care. Ages range from 18 months to 12 years. The day care will be open five days a week, Monday through Friday, from 6:00 AM to 6:00 PM. Music classes start after 6:00 PM.

Mrs. Long asked about the requirements for a fence. She said the State didn’t say anything about a fence, but township secretary, Sharon Shaub, explained it is one of the requirements in our Zoning Resolution for a day care center. (Copy attached)
With no further questions from the Board, no correspondence or phone calls received at the township office and no one in attendance to speak either for or against this variance, Gary Brahler asked for a motion for a ballot vote.
FLOYD FERNANDEZ MOTIONED FOR A BALLOT VOTE SECONDED BY BILL EHLERS. ALL VOTED YES. MOTION CARRIED. BALLOT VOTE WENT AS FOLLOWS:

Vice Chairman Brahler stated the request for the variance for a Conditional Zoning Certificate for a Type ‘A’ Child Care Center in her home, which is to be added to Mrs. Long’s current Conditional Zoning Certificate #714, was APPROVED and instructed Mrs. Long to make arrangements to meet with Mr. Lasure to discuss the fence situation discussed above.
