BOARD OF ZONING APPEALS

TUESDAY, AUGUST 4, 2009 – 7:00 PM

Purpose:

·        Appeal #556 – Allen E. Gress, 5470 Alcorn NE – requesting a variance to build an accessory building within 42” from the north side of the property line instead of the required distance of 8’.  These are the requirements for accessory buildings, structures and uses per Section 602.4 of the Nimishillen Township Zoning Resolution.

 

Chairman Dale Riggenbach called the meeting to order at 7:00 PM and introduced the Board, Zoning Inspector and Township Secretary, Sharon Shaub, and did a mass swearing in of everyone in attendance of tonight’s hearings.

 

HEARING OF TONIGHT’S CASE:

 

APPEAL #556:

 

Allen E. Gress of 5470 Alcorn NE stepped to the podium stating he is requesting a variance for an accessory building to be within 42” from the north side of his property instead of the required 8’ as stated in the township zoning book.  Mr. Gress stated he would keep his garden supplies & tools in the building.  All-Pro Builders from Canton will be putting in the accessory building.

 

Chairman Riggenbach asked if the Board had any questions.

 

Alternate Board Member, Mr. Metzger of 7878 Pilot Knob, stepped to the podium and asked Mr. Gress if he verified that there were no easements for utilities.  Mr. Gress said he had not checked but said it’s a corner lot and all of the utilities run down the other side of the street and everything is in the front. Mr. Metzger said utilities usually get easements afterwards and they are normally not on any map.  However, it was determined all utilities / electrical boxes / cable in this allotment are in the front and Mr. Fernandez said he watched them put all of them in.

 

With no one else to speak either for or against this variance and no calls or letters received at the township office, Chairman Riggenbach asked for a motion for a ballot vote.

 

NICHOLAS REYNOLDS MOTIONED FOR A BALLOT VOTE FOR APPEAL #556 FOR A VARIANCE FOR AN ACCESSORY BUILDING TO BE WITHIN 42” FROM THE N. SIDE OF THE PROPERTY INSTEAD OF THE REQUIRED 8’ SECONDED BY PAN ASLANIDES.  MOTION CARRIED.   APPROVED.  Voting went as follows:
