ZONING BOARD OF APPEALS

FEBRUARY 7, 2005

Purpose:

  • Timothy Barr, 5210 Peach – Conditional Use Permit
  • Timothy Link, 5103 Broadway – Conditional Use Permit
  • Chad Deeser, 140 Genoa SW, Massillon – Variance for New Residence
  • Organizational Meeting (Tabled from January 4, 2005)

 

Vice Chairman Dennis Haas opened the meeting at 7:00 P.M. and introduced the Zoning Board of Appeals.  Mr. Haas swore in everyone in attendance by asking them to swear that the information they were about to present, either in oral or written form, was true and accurate to the best of their knowledge.  The people responded by stating, “I do”.

 

The first case that was heard was Timothy Barr of 5210 Peach NE.  Mr. Barr stepped to the podium requesting a variance for a Conditional Zoning Certificate for a home occupation for home inspections.  Mr. Barr stated he inspects homes for realtors, home sellers or buyers or anyone who needs a home inspection.  The only business he actually conducts in his home is answering the phone and computer work.  Everything else is done on site.  Mr. Barr stated he wanted to put a sign up for his business and was told he would have to apply for a Conditional Zoning Certificate for a home business.  Under this permit, he would be allowed to have a small sign.

 

Vice Chairman Haas asked if the Board had any questions.  Phyllis McKean questioned the name of the company.  Mr. Barr stated it is Constitution Home Inspections and stated he has his State license.

 

Mr. Haas stated this is an annual permit and renewable yearly.  Since there was no one in the audience to speak for or against this variance and there was no correspondence received, Mr. Haas asked for a motion for a ballot vote.  Phyllis McKean motioned for a ballot vote seconded by Louise Vance.  The variance for the Conditional Zoning Certificate was APPROVED.  The voting went as follows:

The second case heard was Timothy Link of 5103 Broadway NE, Louisville.  Mr. Link stepped to the podium requesting a variance for a Conditional Zoning Certificate for a home occupation for a tree trimming business.  Mr. Link stated he parks his trucks at this location and uses the phone for business.

 

Phyllis McKean asked Mr. Link if he cut his wood away from the premises.  Mr. Link stated he has a tree trimming business and stacks the wood at his home for his personal use.  Dennis Haas asked how many trucks he would have parked at this location.  Mr. Link stated three.  Phyllis McKean asked if he had a garage.  Mr. Link stated he does but it’s not big enough for the trucks.  Nic Reynolds asked if this was something he would anticipate in the future.  Mr. Link said that eventually he would need a larger garage.

 

Louise Vance asked secretary, Sharon Shaub, if anyone called in or if there was any correspondence.  Sharon stated there was none.

 

Dennis Haas asked how long he has been operating this business.  Mr. Link said six years.  Mr. Haas explained that this type of permit would need to be renewed annually.

 

Since there were no more questions and there was no one in the audience to speak either for or against this variance, Vice Chairman Haas asked for a ballot vote.  Louise Vance motioned for a ballot vote seconded by Nic Reynolds.  The variance for the Conditional Zoning Certificate was APPROVED.  The voting went as follows:

                                           Louise Vance        -  Yes

The third case heard was Chad Deeser of 140 Genoa SW, Massillon, Ohio.  Mr. Deeser is requesting a variance for a new residence to be built within 25 feet on the north side of the structure rather than the required 30 feet.  The property is located at the corner of Skyridge Avenue and Willa Avenue in Louisville, Ohio, S/L 27 Skyridge, Sunscape Allotment.

 

The contractor, Mr. Wendell Sommers of 3106 Edison Street, stepped to the podium to speak for Mr. Deeser.  He stated the problem they ran into is the placement of the house because it’s a corner lot.  He stated the front corner of the home extended over about five feet towards the road.

 

Vice Chairman Haas said in looking at the shape of the lot, if you would move the house back you could get another five feet but is assuming it’s in line with the other houses.  Mr. Sommers said they slid it back a few feet behind the neighboring homes to try to accommodate the best they could but what happened is if you slide it back that far, you are essentially looking at the neighbor’s back yard and this would also minimize the back yard.

Vice Chairman Haas asked if there were any questions from the Board.  Since there were no questions and there was no one in the audience to speak for or against this variance, Mr. Haas asked for a motion for a ballot vote.  Phyllis McKean motioned for a ballot vote seconded by Louise Vance.  The variance was APPROVED.  The voting went as follows:

At this time, Vice Chairman Haas welcomed Dale Riggenbach to the Board.  Mr. Riggenbach is replacing Don Keefe.

 

Old Business:  Since the Organizational Meeting was tabled from the January 2005 meeting, Vice Chairman Haas asked for a nomination for Chairman for 2005.  Louise Vance nominated Dennis Haas seconded by Phyllis McKean.  All voted yes.  Motion carried.

 

Mr. Haas asked for a nomination for Vice Chairman.  Phyllis McKean nominated Nic Reynolds seconded by Dennis Haas.  All voted yes.  Motion carried.

 

Mr. Haas asked for a nomination for Secretary.  Phyllis McKean nominated Louise Vance seconded by Dennis Haas.  All voted yes.  Motion carried.

 

The Board agreed to meet the first Monday of each month at 7:00 p.m.

 

New Business:  The annual RPC Dinner at Skyland Pines is March 15th at 6:00 p.m.  The township decided to pay for everyone’s dinner this year.  Those who would like to attend need to let Sharon know prior to March 9th.

 

Trustee Russ Goffus stepped to the podium and reported on the conference he attended in Columbus.  He attended a class on zoning.  There were some changes made.  Mr. Goffus passed out a copy with information on changes made.

 

Approval of Minutes from January 4, 2005:  Phyllis McKean motioned to approve the minutes as written seconded by Louise Vance.  All were in favor.  Motion carried.

 

Adjournment:  Louise Vance motioned to adjourn seconded by Nic Reynolds.  All were in favor.  Motion carried.  The meeting adjourned at 7:30 p.m.
